The Court of Appeal sitting in Koforidua today granted an application for interlocutory injunction brought by Professor Margaret Kweku and other petitioners from the SALL traditional areas to restrain John Peter Amewu from holding himself out as a Member of Parliament for Hohoe Constituency in the 8th parliament of the Fourth Republic and also to restrain the Speaker of Parliament from processing or paying any entitlements to Mr Amewu as the former member of parliament pending the hearing and determination of the appeal.
The Ho High Court presided over by Justice Owoahene Acheampong on July 29, 2024 had dismissed the election petition against the election of Peter Amewu on the basis that the High Court lacked jurisdiction. A Notice of Appeal was filed on July 31, 2024, against the decision. The application for interlocutory injunction was filed on December 23, 2024.
Arguing the application, Mr Tsatsu Tsikata urged the court in the interest of justice to prevent the Speaker of Parliament from processing or paying any entitlements to Mr Amewu pending the hearing and determination of the appeal.
Mr Kofitse, Counsel for Mr Amewu argued that the 2nd Respondent had done nothing wrong and that if anything, the electoral commission should be held responsible for misleading the 2nd Respondent Mr Amewu.
The Court presided over by Justice Bright Mensah held that the application was meritorious. Other members of panel were Justice Noble Nkrumah and Justice Hafisata Amaleboba (Mrs).
